Service charges are probably the main area of potential dispute between the parties to a lease. Lessees are becoming increasingly aware that they might challenge service charges in the Leasehold Valuation Tribunal.
If the charges, or the process are wrong, them they are liable to be reduced – possibly substantially, potentially totally. This can be catastrophic where a decision on one property can be rolled out to a whole estate – as cases widely reported in the housing press recently have pointed out.
It is crucial that those responsible for the management of leasehold property have a detailed and working knowledge of the law and process of the complex legal framework in this area if they are to effectively manage their stock.
